TERMS AND CONDITIONS

GUARANTEE:

Section 1a: Basic Warranty

All our work is guaranteed for one year from the date of initial service contract. APPLIES TO SERVICES DONE AND MATERIALS SUPPLIED ONLY.

  • Please note our guarantee does not cover additional holes or other damage caused by displaced animals (new charges may apply).
  • Please allow 5 days for all wildlife to exit and kindly call to have your one-way door system removed at (416) 792-5181.
  • All estimates are sent separately.
  • All estimates are valid for 30 days from the date of estimate.

SWAT Wildlife Inc. Premium Protection Plan (PPP)

Terms and Conditions – Extended Wildlife Exclusion Warranty

These Terms and Conditions (“Agreement”) govern the Premium Protection Plan (“PPP Warranty”) provided by SWAT Wildlife Inc. (“SWAT Wildlife,” “Company,” “we,” “our,” or “us”) for wildlife exclusion and animal-proofing services performed on residential and commercial structures.

By purchasing or accepting services covered under the PPP Warranty, the property owner (“Customer,” “Owner,” or “you”) agrees to be bound by the terms outlined below.

1. Scope of Warranty Coverage

The PPP Warranty applies exclusively to wildlife exclusion, screening, sealing, reinforcement, and animal-proofing systems installed directly by SWAT Wildlife Inc. on the structure identified in the original invoice or work order.

Covered systems may include:

  • Roof vent screening
  • Soffit and fascia protection
  • Roofline reinforcement
  • Chimney cap installations
  • Exhaust vent protection
  • Plumbing stack protection
  • Wildlife barrier systems
  • Aluminum flashing
  • Steel mesh installations
  • House fusing and gap sealing
  • Roof intersection protection
  • Other exclusion devices specifically listed on the original invoice

Where all repairs, exclusions, recommendations, and vulnerable areas identified by SWAT Wildlife Inc. have been completed in full, warranty coverage shall apply to the entire roof system and protected roofline against re-entry by covered wildlife species during the applicable warranty period.

2. Warranty Eligibility

The PPP Warranty is valid only when:

  • Full payment for services has been received by SWAT Wildlife Inc.
  • The warranty has been specifically purchased or included in writing on the original invoice.
  • All recommended exclusion, repair, and prevention work identified by SWAT Wildlife Inc. has been completed.
  • The original installation was completed by SWAT Wildlife Inc.
  • The property owner complies with all maintenance obligations outlined herein.

Eligibility for the PPP Warranty is determined at the sole discretion of SWAT Wildlife Inc. and its authorized technicians.

SWAT Wildlife Inc. reserves the right to approve or deny warranty eligibility based on factors including, but not limited to:

  • Structural condition and integrity of the roof and building envelope
  • Existing or potential vulnerabilities that cannot be reasonably mitigated
  • Safety concerns or access limitations
  • Any conditions that may compromise the effectiveness or longevity of exclusion work

SWAT Wildlife Inc. further reserves the right to decline or revoke warranty eligibility where circumstances arise that make continued service impractical, unsafe, or commercially unreasonable.

This warranty is non-transferable unless expressly authorized in writing by SWAT Wildlife Inc.

3. Warranty Term

3.1 Five-Year Warranty

The Five-Year PPP Warranty remains valid for five (5) years from the original installation date listed on the invoice.

3.2 Lifetime Warranty

The Lifetime PPP Warranty remains valid only for:

  • The lifetime of the original property owner
  • While the original owner continuously owns and occupies the property

The Lifetime Warranty automatically terminates upon:

  • Sale or transfer of the property
  • Change in ownership
  • Conversion to rental, commercial, vacant, or investment use
  • Demolition or major structural alteration of the building

4. What Is Covered

Subject to the limitations and exclusions contained herein, SWAT Wildlife Inc. agrees to repair or replace covered exclusion materials that fail solely due to:

  • Defective workmanship performed by SWAT Wildlife Inc.
  • Failure of materials originally supplied and installed by SWAT Wildlife Inc.

If covered wildlife regain access to the roof or attic area through the roof system after all recommended exclusion work has been completed, SWAT Wildlife Inc. will provide corrective exclusion repairs at no additional labour cost during the active warranty term.

SWAT Wildlife Inc. reserves the right to determine the appropriate repair method at its sole discretion.

5. Species Covered and Excluded

Unless otherwise specified in writing on the original invoice or warranty documentation, this warranty applies only to the wildlife species specifically addressed during the original service.

Excluded Species

This warranty does not include coverage for:

  • Rats
  • Mice
  • Bats
  • Insects, including but not limited to:
    • Wasps
    • Bees
    • Hornets
    • Ants
    • Bed bugs
    • Cockroaches
  • Any pest control or extermination services

Coverage for excluded species shall apply only where explicitly listed in writing on the invoice or warranty agreement.

5.1 Conditional Coverage for Bats

Notwithstanding the exclusions above, bats may be included under warranty coverage solely at the discretion of SWAT Wildlife Inc. and its authorized technician.

Bat-related coverage shall apply only where:

  • The primary purpose of the original service was specifically for bat exclusion
  • Bat exclusion work is explicitly identified in writing on the original invoice or warranty documentation
  • The technician has confirmed that the structure is suitable for bat-proofing under the PPP Warranty

All determinations regarding eligibility, scope, and effectiveness of bat exclusion coverage shall be made at the sole discretion of SWAT Wildlife Inc.

5.2 Compliance with Wildlife Laws – All Species

All wildlife control, exclusion, removal, and prevention services performed by SWAT Wildlife Inc. are subject to applicable federal, provincial, and municipal laws and regulations.

SWAT Wildlife Inc. shall not perform any service that is restricted, regulated, or prohibited by law, including but not limited to:

  • Activities during breeding, nesting, or denning periods
  • Removal or disturbance of protected species
  • Any service that would result in unlawful relocation of wildlife

Where legal or regulatory restrictions apply:

  • Services may be delayed, rescheduled, or modified
  • Temporary measures may be implemented
  • Certain areas may remain untreated where intervention is not legally permitted

SWAT Wildlife Inc. shall not be liable for delays or recurring wildlife activity resulting from legal compliance requirements.

6. Exclusions From Coverage

6.1 Structural or Property Conditions

This warranty excludes issues caused by:

  • Aging roofs or roofing systems
  • Deteriorated shingles, soffits, fascia, siding, brickwork, or flashing
  • Water damage or rot
  • Improper construction
  • Structural shifting or settlement
  • Mold, mildew, or moisture issues

6.2 Acts of Nature or External Forces

This warranty excludes:

  • Windstorms
  • Hail
  • Lightning
  • Tornadoes
  • Flooding
  • Fire
  • Ice damage
  • Fallen trees or branches
  • Earthquakes
  • Severe weather events
  • Any act of God

6.3 Third-Party Work or Alterations

Any roofing, siding, eavestrough, HVAC, satellite, telecommunications, renovation, or construction work performed after installation by parties other than SWAT Wildlife Inc. may void warranty coverage.

6.4 Interior or Property Damage

This warranty does not cover:

  • Interior contamination
  • Insulation replacement
  • Drywall or ceiling damage
  • Electrical damage
  • Plumbing damage
  • HVAC damage
  • Personal property damage
  • Odours
  • Feces or urine cleanup
  • Biohazard remediation
  • Cosmetic repairs
  • Damage caused by wildlife prior to discovery or service

SWAT Wildlife Inc. provides wildlife exclusion services only and is not responsible for property damage caused by wildlife activity.

6.5 Neglect or Failure to Maintain

Failure by the property owner to maintain the property, roof, soffits, vents, or surrounding structure may void warranty coverage.

7. Customer Responsibilities

The Customer agrees to:

  • Promptly report signs of wildlife activity or exclusion failure
  • Maintain the structure in good repair
  • Prevent accumulation of conditions that may attract wildlife
  • Allow reasonable access for inspections and repairs
  • Avoid tampering with installed systems
  • Cooperate with SWAT Wildlife Inc. personnel during service delivery

Failure to comply may result in denial or termination of warranty coverage.

8. Warranty Claim Procedure

To submit a warranty claim, the Customer must:

  • Contact SWAT Wildlife Inc. immediately upon discovering the issue
  • Provide proof of purchase and warranty eligibility
  • Provide photographs or descriptions if requested
  • Permit inspection of the property by SWAT Wildlife Inc.

SWAT Wildlife Inc. reserves the right to inspect the alleged defect prior to approving repairs.

9. Inspection Fees and Repeat Service Calls

SWAT Wildlife Inc. reserves the right to charge inspection or service call fees where:

  • Multiple service requests are made without evidence of wildlife re-entry
  • Inspections confirm no failure of installed systems
  • The issue falls outside warranty coverage
  • Repeated requests require technician attendance without actionable findings

10. Access and Safety Conditions

Warranty service may be delayed, refused, or excluded where:

  • Unsafe roof conditions exist
  • Weather conditions prevent safe access
  • Snow, ice, or environmental hazards obstruct work
  • Access equipment cannot be safely deployed
  • Wildlife protection laws prevent service

11. Limitation of Liability

To the fullest extent permitted by law:

  • SWAT Wildlife Inc.’s maximum liability shall not exceed the original amount paid for covered services.
  • SWAT Wildlife Inc. shall not be liable for indirect, incidental, special, punitive, or consequential damages.
  • SWAT Wildlife Inc. shall not be responsible for damage caused by wildlife activity.

No employee or representative may modify these limitations except in writing signed by an authorized officer of the Company.

12. No Other Warranties

Except as expressly stated herein, SWAT Wildlife Inc. disclaims all other warranties, express or implied, including:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Guarantees of permanent wildlife prevention

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be resolved exclusively within the courts located in Ontario, Canada.

14. Severability

If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between SWAT Wildlife Inc. and the Customer regarding the PPP Warranty and supersede all prior verbal or written representations.

16. Amendments

SWAT Wildlife Inc. reserves the right to amend, modify, or update these Terms and Conditions at any time.

Any amendments shall not retroactively affect active warranties issued prior to the effective date of revised terms unless required by law.

NO WARRANTY

The following are not covered under the Premium Protection Plan:

  • Mice/Rat treatments
  • Damage to shingles or roofing areas caused by displaced or other wildlife within the warranty period

Additional services and warranties may be available through SWAT Wildlife Inc.

VOIDED WARRANTY

If the original installation by SWAT Wildlife Inc. has been altered or removed, the Premium Protection Plan will be voided unless approved by SWAT Wildlife Inc. following inspection by a service technician.

Additional Service Terms

Section 2a:

MICE TREATMENT GUARANTEE:

Six month guarantee with no live mice found on site. (Please allow 2-3 weeks for best results.)Please note this is not a mice exclusion and periodically mice will feed on placed bait.

Section 2b:

Rodent exclusion

Houses and buildings that qualify for mice exclusions will be Guaranteed for one year from date of initial contract. Exclusion work will be carried out by technicians, covering all openings and potential openings determined after inspection. If property damage occurs after date of installation, allowing rodents to enter, this will not be covered under the exclusion and will be subject to additional chargers

Section 2c:

Snap Trapping

This service does not come with any guarantee, snap traps are placed to control the population and are there to assist in the removal of rats. SWAT Wildlife Inc will not refund customers if snap traps are not successful in trapping rodents. Exclusion work is always recommended when possible to get control and stop animals from entering the structure. Rodenticides can be combined with this service if the technician feels it is necessary. SWAT Wildlife Inc is not responsible for locating or retrieving dead rodents behind any structure within the house, or containing any odour that may occur from dead rodents.

Section 3:

Live trapping

Humane live trapping is often the only solution in the removal process. This service does not come with any guarantee. However, SWAT Wildlife Inc has great success with this service when it is the only option. SWAT Wildlife Inc will rent and service its equipment at quoted pricing at the time the trap is set. This service is non refundable if the traps are unsuccessful at trapping the intended animal, or any animal at all. Customers may assist in checking traps daily and calling the SWAT Wildlife Inc offices to have animals relocated. If customers are not comfortable or unable to check traps daily, we ask that they coordinate with our office for team members to do so.

Section 4:

Attic Top ups and Insulation services

If at any time an animal breaches a client's roof and damages newly installed insulation SWAT Wildlife Inc is not responsible for said damage. It is recommended that Premium Protection Plans be purchased in conjunction with insulation products to protect investment and maximise warranty

Section 5:

Exterior Bait Station services.

Exterior Bait stations are used around properties to get control of rodent populations. This service does not come with any guarantee. If a customer wants to terminate the bait station service program early no refunds will be given in exchange for discounted time once service has commenced.

Please ensure all bait stations are accessible so the service technician can replenish them. Keep gates and doors clear of ice and snow. Failure to do so may result in missed service.

*REFUND POLICY*

At SWAT Wildlife Inc., we take pride in providing high-quality wildlife and pest control services. To ensure clarity and transparency, we have established the following No Refund Policy for all sales and services rendered:

1. All Sales & Services Are Final

All purchases of SWAT Wildlife Inc. services, including but not limited to wildlife removal, pest control, prevention, and repair services, are final. Once a service has been scheduled and/or completed, no refunds will be issued.

2. No Refunds on Deposits or Fees

Any deposits, service fees, or inspection fees paid to SWAT Wildlife Inc. are non-refundable. These fees cover the cost of labor, equipment, and time allocated to addressing your wildlife or pest concerns.

3. Warranty & Service Guarantee

While we do not offer refunds, SWAT Wildlife Inc. stands behind the quality of our work. We may provide warranties on specific services as outlined in your service agreement. If an issue arises within the warranty period, we will work to resolve it in accordance with the terms of the warranty.

4. Cancellations & Rescheduling

Clients may request to reschedule a service appointment with at least 24 hours’ notice. Failure to provide sufficient notice may result in forfeiture of any payments made.

5. Exceptions

Refunds may only be considered in rare cases of extenuating circumstances, solely at the discretion of SWAT Wildlife Inc. Any such requests must be submitted in writing to info@swatwildlife.com within 24 hours of the service date.
